Alabama is scheduled to execute Jeffery Lee by lethal injection at William C. Holman Correctional Facility for the 1998 killings of pawn shop owner Jimmy Ellis and employee Elaine Thompson.
The victims were killed during a robbery at the business in Orrville, Dallas County, on Dec. 12, 1998.
The state changed Lee’s execution method after a judge blocked plans to use nitrogen hypoxia three months ago. Alabama began using nitrogen gas as an execution method in 2024, but lethal injection remains the state’s primary method.
Lee’s case also involves Alabama’s former judicial override system. Although his jury recommended life imprisonment by a 7-5 vote, the trial judge imposed a death sentence. Alabama abolished judicial override in 2017, but the change was not retroactive.
The case comes amid continuing legal challenges over execution methods and protocols in several states.
