Florida Attorney General James Uthmeier has sued Netflix, alleging the streaming company collected children’s viewing data and shared user information with advertisers despite promoting its service as safe and privacy-focused.

The lawsuit alleges Netflix marketed children’s profiles as a dedicated space for users aged 12 and under while collecting behavioral information through systems also used for adult accounts.

The company launched an advertising-supported subscription tier in November 2022, according to the complaint.

Uthmeier is seeking a permanent injunction, civil penalties and the deletion of data allegedly collected in violation of Florida’s Deceptive and Unfair Trade Practices Act and Digital Bill of Rights.

The case is part of Florida’s broader efforts to hold technology companies accountable for potential harms involving children.

Netflix executives had previously described the platform as a safe environment that did not collect user data, according to the lawsuit.

Netflix had not publicly responded to the allegations as of Wednesday.
