Luigi Mangione, the 27-year-old accused of murdering former UnitedHealthcare CEO Brian Thompson, returned to New York state court Tuesday for the first time since February. The judge is weighing defense motions that could reshape the case, including a bid to dismiss the indictment and suppress evidence.
Mangione’s attorneys argue the state charges violate the Constitution’s double jeopardy clause because he also faces federal charges for the same killing. The Justice Department is pursuing the death penalty, while the state case carries a possible life sentence. Prosecutors insist the state trial should proceed first.

Mangione faces 11 counts, including terrorism-related charges. His lawyers contend the case has been inflated into terrorism by law enforcement leaks of writings and bullet inscriptions.

Prosecutors counter that the attack was a calculated assassination designed to send a political message. Supporters continue to rally outside court, while Mangione has raised over $1.2 million in donations.
