Supreme Court Pauses Ruling Blocking Third-Country Deportations

The Supreme Court on Tuesday cleared the way for the Trump administration to resume deporting certain immigrants to third countries with which they have no previous connection.

The justices granted an emergency request to pause an appeals court ruling that had found the practice unlawful.

The appeals court had ruled that affected immigrants were not given a meaningful opportunity to raise concerns about potential persecution or safety risks in the countries where they could be sent.

Solicitor General John Sauer said the ruling had created logistical difficulties, including the cancellation of a flight carrying 70 people with criminal convictions.

The Migration Policy Institute estimates that about 15,000 people have been sent to third countries, including South Sudan, Eswatini and Rwanda, since the policy began in early 2025.

The Supreme Court is scheduled to hear oral arguments in December and is expected to issue a definitive ruling on the administration’s authority.
