The Trump administration is proposing a $103,265 fee for certain H-1B visa petitions, potentially making the program significantly more expensive for U.S. employers seeking skilled foreign workers.

The Department of Homeland Security proposal would apply to petitions subject to the annual 85,000-visa cap, including 20,000 reserved for workers with advanced degrees.

The proposal follows President Donald Trump's 2025 order imposing a $100,000 H-1B charge, which federal courts struck down. DHS argues the new proposal relies on different legal authority and could establish the fee permanently.

Supporters of tighter H-1B restrictions argue the program can allow companies to suppress wages and replace American workers. Business groups counter that the visas are important for recruiting specialised talent when qualified U.S. workers are unavailable.

The rule's publication begins a 30-day public comment period. Universities and nonprofit research organisations would be exempt, while DHS is also considering higher fees for other immigration-related applications.
