A judge on Thursday rejected Lindsay Clancy’s request for a not-guilty finding in the deaths of her three children, ruling that prosecutors had presented sufficient evidence for the case to be decided by a jury.
The decision followed a mistrial declared September 4 after jurors reportedly deadlocked 11-1 in favor of acquittal. Clancy’s attorney, Kevin Reddington, argued earlier this week that prosecutors had not established that Clancy was responsible for the deaths or that she was not experiencing psychosis at the time.
The judge pointed to GPS data and surveillance footage indicating that Clancy was the only person at home when the children died.
The court is expected to consider those issues at a hearing scheduled for November 2, while prosecutors could seek a retrial.
