Former special counsel Jack Smith is set to testify before the Senate Judiciary Committee about his investigations and prosecutions involving President Donald Trump, according to CBS News.

Smith brought two federal cases against Trump after his first presidential term. One concerned classified government documents retained after leaving office, while the other involved efforts to challenge the 2020 election results. Trump pleaded not guilty in both cases, which ended after he won the 2024 election.

Republicans have accused Smith of exceeding his authority, including over efforts by his team to obtain telephone metadata from some Republican senators. House Judiciary Chairman Jim Jordan referred Smith to the Justice Department for possible prosecution over statements concerning those records.

In prepared remarks obtained by CBS News, Smith is expected to defend his decisions, saying his investigations were conducted without regard to Trump’s political affiliation. He is also expected to address Trump’s calls for his prosecution and warn about threats to the rule of law.

The hearing is scheduled for Tuesday on Capitol Hill.
