A 73-year-old Ohio man accused of child endangerment after 16 grandchildren were found living in deplorable conditions has been declared incompetent to stand trial.
Vinton County Common Pleas Court Judge Laina Fetherolf Rogers ruled Wednesday that Gary Siders Sr. is mentally incompetent to participate in criminal proceedings. Siders appeared in court in a wheelchair.
His attorney, Dorian Baum, said Siders’ condition is “not restorable,” while the underlying competency evaluation remains sealed.
Baum expects the charges against Siders Sr. to be dismissed. Prosecutor William Archer did not oppose the competency ruling, though the state could pursue civil commitment to ensure Siders receives continued care outside the criminal justice system.
Other family members remain charged and face their own competency evaluations.
