Canadian contractor Mitchell Fairbarn was found guilty of animal cruelty after taking Peachy the flamingo from the Flamingo Las Vegas Hotel exhibit.

During his trial, Fairbarn testified that he had consumed 30 to 40 beers before entering the bird’s habitat around 5 a.m. on March 3. In Las Vegas for the ConExpo construction show, he described the incident as a “silly pranky joke” and said he wanted to inspect a bird whose wings appeared uneven.

Surveillance footage showed him handling the flamingo by its neck. A veterinarian reported injuries including missing feathers and blood loss. Fairbarn denied intending to harm the bird but acknowledged that the incident “doesn’t look good” and accepted responsibility for its injuries.

The case involved two animal cruelty charges. A conviction carries a potential prison sentence of one to four years and a fine of up to $5,000.
