Richard Allen Seeks New Trial In Delphi Teen Murders

Richard Allen, who is serving a 130-year sentence for the murders of two Indiana teenagers, is seeking a new trial as his case reaches the Indiana Court of Appeals.

His attorneys argue that problems surrounding his confinement, defense strategy and the admission of evidence affected the fairness of his original trial.

The defense says Allen experienced severe psychological deterioration while held in solitary confinement before trial, including significant weight loss and difficulty caring for himself.

His attorneys also argue that the trial court improperly prevented them from presenting a theory that the killings were connected to a pagan ritual involving people who worshipped Odin. Prosecutors had described that theory as unsupported and sought to keep it from the jury.

The appeal also challenges aspects of the prosecution’s evidence, including conflicting descriptions of a suspicious man seen near the Delphi trail and the exclusion of an expert who could have questioned ballistic evidence linking a bullet found at the crime scene to Allen’s handgun.

Prosecutors maintain that the jury had sufficient evidence to convict Allen, including his confessions. The appeals court must now consider the defense arguments and the state’s response.
