California and six other states sued the Trump administration on Wednesday over its decision to withhold about $810 million in federal funds that Congress had previously approved.
The lawsuit challenges the administration’s use of a process known as a “pocket rescission” to cancel the funding.
Filed in the U.S. District Court for the Northern District of California, the case is led by California Attorney General Rob Bonta.
The states argue that withholding funds approved by Congress violates constitutional limits on presidential spending authority and the separation of powers.
Bonta said the administration cannot decline to spend appropriated money based solely on disagreement with the programs.
The lawsuit adds to ongoing legal disputes over the administration’s authority to withhold or cancel federal funds after Congress has approved them.
