Texas Delivery Driver Has Bullet Removed 11 Days After ICE Shooting

Federal testimony revealed that the officer who fired the shot was not wearing a body camera, while another officer had deactivated his camera before arriving.

Venezuelan delivery driver Wilber Rafael Garces Perez underwent surgery Thursday in Austin, Texas, to remove a bullet that had remained lodged in his back for 11 days after he was shot by an Immigration and Customs Enforcement officer on September 20.

ICE officers stopped Garces Perez in North Austin during the incident. Authorities allege he attempted to strike an officer with his vehicle, while Garces Perez has said an SUV hit him first.

Garces Perez remains in U.S. Marshals Service custody after a judge determined he was a flight risk. Federal prosecutors have charged him with assaulting a federal officer, an offense carrying a potential sentence of up to 20 years.

Demonstrators have protested the operation in Austin, while Rep. Joaquin Castro and Garces Perez’s attorneys have criticized the use of force and raised questions about federal enforcement practices.
