Former FBI Director James Comey is facing new federal charges over an alleged 2016 disclosure of national defence information, according to court documents unsealed on Monday.
Prosecutors allege Comey directed staff to share sensitive information with a New York Times reporter.
His lawyers are seeking dismissal, arguing that prosecutors failed to meet the statute of limitations because they filed a charging document rather than obtaining a grand jury indictment. The Justice Department maintains that its filing preserved the deadline.
The case marks Comey’s third criminal prosecution in just over a year.
An earlier case involving congressional testimony was dismissed after a judge questioned the prosecutor’s appointment, while a separate case concerning an Instagram post remains pending. Comey has repeatedly alleged political motivation.
