Friday marked a somber day for America as the nation crossed a Rubicon with the 37-count criminal indictment of former President Trump, making it the first-ever federal indictment of a former president in the nation's history. Trump now faces a maximum sentence of 400 years in prison and a $9M fine due to the indictment.
Ongoing War
Americans must realize that there is more to this situation than meets the eye. The administrative state has been waging a war against Donald Trump, and Friday's indictment is the most recent development in this ongoing conflict—a fresh offensive against Trump. The administrative state is torpedoing Trump with lawfare, aiming to break his resolve and force him to stand down from running in 2024.
The war actually began before the 2016 election, when the FBI initiated a counterintelligence probe called 'Crossfire Hurricane' without proper justification. Following the inauguration, the administrative state launched a relentless assault on the new president, who was a non-politician, through the protracted Russia hoax.
President Trump recognizes this.
At the CPAC 2023, he said: “I didn’t know that they want to lynch you for doing nothing wrong. I didn’t know they want to lynch you for doing a great job. I didn’t know they want to put you away because your poll numbers are better than anybody they’ve seen in years.”
Politically, Trump is winning. He is the frontrunner for the Republican party for the 2024 presidential race.
He is also winning in the game of optics. For example, the recent Durham Report disproved claims that the Trump campaign colluded with Russia to win the 2016 election. The FBI and the DOJ looked terrible for perpetrating the hoax for nearly three years, and President Trump was vindicated.
Deep State And Media Are Terrified
The administrative state and its media partners are deeply terrified by the prospect of Trump's potential return to the presidency in 2024. Their fear is palpable, and a few recent examples echo this deep-seated unease.
MSNBC’s Jen Psaki’s sit-down interview with Former FBI Director James Comey aired past Sunday.
Comey told Psaki, 'Think about what four years of a retribution presidency might look like. He could order the investigation and prosecution of individuals who he sees as enemies.'
Comey usually moved with a macho swagger, expressing confidence, and this from him was stunning. Though he is retired, the deep state is run by his colleagues, who led the FBI's past investigations like Crossfire Hurricane. It is reasonable to believe that the administrative state must feel like Comey.
The media, often considered friends of the deep state accustomed to being fed a regular diet of DOJ/FBI leaks, are now floating the idea of a plea bargain to remove Trump from the 2024 race.
For example, Rachel Maddow recently floated the idea that the DOJ drop all charges against Trump if he drops out of the run for 2024. She said: “You have to wonder if the Justice Department is considering whether there is some political solution to this criminal problem, whether part of the issue here is not just that Trump has committed crimes, but that Trump has committed crimes and plans on being back in the White House.”
She added, “Do they consider as part of a potential plea offer, something that would prescribe him, proscribe him from running for office again? I don't know. I would imagine if anything like that happened, that it would have to come from the defense side of the negotiation, that the Trump team would say, oh, by the way, and with this, we will also drop out of the race for president.”
Constitutional And Political Issues
We recently editorialized about why Merrick Garland must put an end to the ongoing legal warfare. The reasons we presented remain valid; unfortunately, our fears are becoming a reality.
Jack Smith, the Special Counsel, reports to Attorney General Merrick Garland, a political appointee of President Biden. It is worth noting that President Biden is running for reelection, most likely against Donald Trump. Thus, the executive branch, led by a president seeking reelection, is prosecuting his potential challenger, who happens to be a former president enjoying certain privileges derived from previously holding office, including secret service protection and the powers regarding presidential records under the Presidential Records Act.
Jack Smith must recognize that Donald Trump is not just anybody; he is the former president. Smith is prosecuting Trump criminally, invoking the Espionage Act, while disregarding the fact that any violations may, at most, be civil under the Presidential Records Act.
Furthermore, President Biden has his own document problems. And then there is the Hunter Biden stuff.
Interestingly, the Justice Department remains leak-proof regarding Biden documents and Hunter Biden, but it consistently provides a steady diet of leaks regarding Trump to the American public.
Reasonable minds wonder if Garland is protecting President Biden and his family while simultaneously undermining Trump through legal warfare. Two examples support the notion that Garland is playing defense for the President. Firstly, there was a recent whistleblower disclosure regarding the IRS dismissing the team investigating Hunter Biden under the direction of the DOJ. Secondly, FBI Director Chris Wray lacked promptness in sharing Form FD-1023 with the Comer Committee.
The DOJ and FBI interfered in the 2016 election by absolving Hillary Clinton of her email server problems. In 2020, they thwarted the dissemination of Hunter Biden's laptop story, collaborating with big technology companies. As we approach 2024, their election interference gambit reaches a whole new level, reflecting the deep state's heightened fear and desperation.
Public Opinion
One-half of Americans in a May Golden/TIPP Poll think that legal actions against Trump are politically oriented. Three-fourths (76%) of Republicans and nearly half of independents (48%) think so.
Even though the media would ignore the recent Durham report, it has affected the FBI’s reputation.
“As the more complete record now shows, there are specific areas of Crossfire Hurricane (the FBI’s covert investigation of the Trump campaign) activity in which the FBI badly underperformed and failed, not only in its duties to the public, but also in preventing the severe reputational harm that has befallen the FBI as a consequence of Crossfire Hurricane,” Special Counsel John Durham wrote in his report, closing a four-year investigation.
Ironically, Special Counsel Jack Smith would say in his statement, “Adherence to the rule of law is a bedrock principle of the Department of Justice.”
Most Americans would disagree with that assessment based on what they have witnessed in the past seven years. They are so disgusted that TIPP Polls have shown 63% of Americans favor either reforming the FBI or shutting down the organization and rebuilding it.
Speaking at CPAC last year to a standing-room-only crowd in a large Dallas hotel ballroom, Trump, in his typical style, talked about how a friend recently remarked to him that he was the most persecuted person in modern history. We agree. The 37 charges of Friday levied by Jack Smith prove that he is the most persecuted person in contemporary history.
