A federal judge has blocked the Trump administration from deporting Kilmar Abrego Garcia until at least early October.

Judge Paula Xinis set an evidentiary hearing for October 6, requiring officials to testify about their efforts to re-deport him.

Garcia, a 30-year-old facing federal human smuggling charges, was detained again by U.S. Immigration and Customs Enforcement after checking in with officers in Baltimore.

According to DHS Secretary Kristi Noem, Abrego Garcia is an MS-13 gang member and child predator whom President Donald Trump will not allow to “terrorize American citizens any longer.”

Abrego Garcia had previously been deported to El Salvador in March but was returned to the U.S. in June to face trial.

His supporters, including immigration activists and Democratic Sen. Chris Van Hollen, frame his case as retaliation for challenging the administration’s immigration enforcement. His federal trial in Tennessee is scheduled for January.
