Lindsay Clancy appeared in a Massachusetts court on Monday as prosecutors and defence lawyers considered whether she will face a second trial over the deaths of her three children in January 2023.
Her first trial ended in a mistrial in September after the jury failed to reach a unanimous verdict. The 11-1 split favoured finding Clancy not criminally responsible due to mental illness.
Prosecutors had alleged that she deliberately killed her children, while her defence argued she was experiencing postpartum psychosis.
He has also challenged the handling of the jury deadlock and sought further investigation of the lone holdout juror. Judge William Sullivan has rejected some requests, citing jury privacy.
Prosecutors have not confirmed whether they will pursue another trial. Clancy could face life imprisonment if convicted.
