A federal judge has ordered Elon Musk to testify under oath in two proposed class-action lawsuits alleging that he and his political action committee, America PAC, misled voters through a $1 million-a-day giveaway during the 2024 U.S. presidential election campaign.

💡
U.S. Magistrate Judge Susan Hightower ruled that Musk must provide sworn testimony as the cases proceed. She also recommended allowing one claim to move forward, alleging that Musk and America PAC deceived voters into providing personal information while signing a petition supporting the U.S. Constitution.

However, the judge recommended dismissing a separate breach-of-contract claim.

The lawsuits were filed by Arizona residents Joy Harvick and Jacqueline McAferty, who contend that voters in seven battleground states were led to believe the daily $1 million prizes would be awarded randomly.

They allege the winners were instead selected based on their potential to serve as spokespersons for America PAC, citing statements made by Musk's legal team.

💡
Musk launched the giveaway during the 2024 election campaign to support Donald Trump's presidential bid. Neither Musk's attorneys nor the plaintiffs' legal representatives immediately commented on the latest court decision.
