A group of news organizations, including The New York Times, The Chicago Tribune, and The New York Daily News, has asked a federal court to impose sanctions on OpenAI and Microsoft in an ongoing copyright lawsuit.

According to the report, the publishers allege the companies engaged in discovery misconduct and failed to preserve evidence relevant to the case.

The report said the motion cites testimony from OpenAI expert John Vincent "Vinnie" Monaco, who allegedly disclosed details about the company's ability to search training datasets for copyrighted material.

Plaintiffs contend OpenAI made misleading statements about those capabilities during the litigation.

According to the report, the publishers are seeking attorney fees, additional court remedies, and jury instructions addressing the alleged destruction of evidence.

The case is expected to play a significant role in determining whether the use of copyrighted material to train artificial intelligence systems qualifies as fair use under U.S. copyright law.
