Apple Wins Dismissal Of iCloud Child Abuse Material Lawsuit

A federal judge has dismissed a class-action lawsuit accusing Apple of failing to prevent child sexual abuse material from being stored and shared through its iCloud service.

According to the report, U.S. District Judge Noël Wise ruled that Apple is protected under Section 230 of the Communications Decency Act, which shields online platforms from certain claims related to third-party content.

The report said the lawsuit, filed on behalf of 2,680 plaintiffs, sought $32.8 billion in compensatory damages, alleging Apple failed to use available technology to detect and remove images depicting child sexual abuse. The judge dismissed the case with prejudice, preventing it from being refiled.

According to the report, the plaintiffs' attorney said they are considering an appeal and argued that Congress should strengthen protections against online child exploitation.

The report added that Apple continues to face a separate lawsuit in West Virginia as courts continue to examine the scope of Section 230 in cases involving online platform design and user safety.
